b.If,inthefirstinstance,youwouldprefertomakeatelephoneenquiry,aprovisionalbookingcanbeheldforamaximumof10days. c.Shouldthedepositnotbereceivedwithin10days,thebookingwilautomaticalybereleased. d.DepositpaymentservesasconfirmationthattheseTerms&ConditionshavebeenreadandthatthepartycontractingwithAthena(hereinafter‘you’)andalguestsagreeto abidebythesetermsandconditions. e.Depositsarenon-refundableinanyeventandpaymentsduecanonlybeacceptedfromyou. f.1finalbalancepaymentisrequired8weekspriortotheevent.Bookingsmadelesthan8weekspriorwilrequirefulpaymentwithintheearlierof10daysfrombookingor twoweeksbeforetheevent. g.Non-paymentofthefinalbalancebytheduedatewilrenderthecontractvoid. h.AVATinvoicewilbeisuedwhenpaymenthasbeenreceived.Aproformainvoicemaybeisuedpriortoreceiptofpayment. i.Thetotalamountdueoneachinvoicemustbesetledwithasinglepayment.Multiplepaymentsarenotaccepted. j.Debit/creditcardpayments,banktransferorchequepaymentsarefreeofcharge. k.Athenaalows16’sandoverintothevenue.However,guestsmustbe18orovertoatendthe‘alinclusive’evenings. 2.BookingChanges a.Bookingchangesareonlyacceptablewhenreceivedfromyou. b.Placesmayberealocatedshouldapartysizedrop. c.Athenawilendeavourtoaccommodatemenuordetailchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeks beforetheeventdate. d.Athenaregretsthatchangestobookings,menuchoicesorwineorderscannotbemadeonthedayoftheevent. 3.RefundsandCancelations a.WholebookingcancelationscanonlybemadebyyouandmustbemadeinwritingtoAthenaatitsregisteredofficeofQueenStreet,Leicester,LE11QDorsuchother addresthatAthenanotifiestoyouinwriting.Cancelationsoverthetelephonecannotbeaccepted. b.Depositsarenon-refundableandnon-transferableandcannotbeusedforanyothergoodsorservicesprovidedbyAthena(includingbutnotlimitedtothebalancepayment ordrinksorders) c.Refundsofthebalancepaymentwilbecalculatedasfolows i.Refund100%lesdeposit,ifcanceledmorethan56dayspriortoyoureventdate. i.Refund75%lesdeposit,ifcanceledmorethan28daysbutlesthan56dayspriortoyoureventdate. i.Refund50%lesdeposit,ifcanceledmorethan14daysbutlesthan28dayspriortoyoureventdate. iv.Norefund,ifcanceled14daysorlespriortoyoureventdate. d.RefundswilbepaidbyAthenaassoonasreasonablyposiblewithin21daysafterreceivingrefunddetailsfromyou. e.Refundedmonieswilbereturnedviatheoriginalmethodofpayment. f.ShouldwebeforcedtocanceloureventsduetoGovernmentrestrictionssuroundingCovid-19,fulticketrefundswilbeisued.Outsideofthis,ourstandardtermsandconditionsapply. 4.Tickets&TablePlans a.YouwilbenotifiedviaemailwhenticketshavebeensentbyAthena2to3weekspriortotheeventdate. b.Duetoon-goingchangesinconfigurations,tableswilnotbealocateduntilthedayoftheevent. c.Shouldindividualplacesetingsberequired,youwilbeabletoalocatetheseduringthePre-dinnerReception,providedthatthisisagreedinadvancewithamemberofthe Athenastaf. 5.MenuPre-orders a.Thereisasetmenuforthisevent,withavegetarianalternative.Athenawilendeavourtoaccommodateanyspecialdietaryrequirementsifrequestedinadvance,alergen informationisheldonaldishesandisavailableonrequest.Athenamustbenotifiedofanydietaryrequirementsnolaterthan2weeksbeforetheeventtothecontactemail addrespublishedonAthena’swebsiteandinitsbrochurefortheapplicableevent. b.Menuchoicesmustbereceivednolaterthan14dayspriortoyourpartydate. c.Athenawilendeavourtoaccommodatemenuchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforethe eventdate. d.IfmenuoptionsarenotmadebeforetheeventthestandardChristmasmenuwilbeserved. e.Athenareservestherighttomakechangestotheadvertisedmenuintheeventofshortagesinthesupplyofparticularitemsbutundertakesthatathree-coursemealwilbe served. f.Whereapartybookingisformorethan1table,pleasenotethat,oncetheguestsareseated,thewaitingstafwilcheckatwhichtabletheguest(s)withspecialdietary requirementsaresitinginordertoasistwithservice. 6.Beverages a.Anypre-orderedbeverages,drinksvouchersordrinkspackagesmustbepaidforinadvance. b.Anydrinksvoucherspurchasedarenon-refundableaftertheevent,cannotbeexchangedforcashontheeveningandareonlyvalidfortheyearasstatedonthedrinks vouchers. c.Nodrinksareincludedintheticketpriceexceptwherestated. d.Pre-ordereddrinkspackagescanonlybepurchasedifoneispurchasedforeachandeveryguestintheparty.Athenaregretsitisunabletomakeconcesionsforguestswho donotrequirethedrinkspackageforanyreasonwhatsoever. e.Attheevent,anyqueriesregardingabeverageordermustbemadewithamemberofstafatthetime.Weadvisethatyoutakeyourbeverageinvoicetotheeventasproof ofpurchase.Anyisuesnotraisedduringtheeveningcannotbedealtwithpostevent. f.Guestsmaynot,underanycircumstances,bringtheirowndrinks. g.Athena’slicenseconditionsdonotpermitbeveragestoberemovedfromthevenue. 7.Miscelaneous a.PricesshownwithinthebrochureincludeVATattherateof20%andaresubjecttochangeshouldtheVATratechange. b.Athenareservestherighttorefuseadmision,andtoremovefromthefunctionanyperson,whoseconditionintheopinionofthestafatthevenueinterferes,orislikelyto interferewith,theenjoymentofthefunctionbyotherparticipants.Thisincludesnon-compliancewiththedrescodestatedinthebrochure,onourwebsiteandontickets. c.Athenadoesnotacceptanyresponsibilityinrespectofanypersonpreventedfromenteringthefunction,oraskedtoleaveduetotheirconduct. d.Athenawiltakeeverycaretohonourcommitments-butreservestherighttoamendoralteralorpartoftheprogrammeofthepartiesandregretthattheywilnotaccept liabilityforerors,changes,omisionsorcancelations. e.Athenadoesnotacceptanyliability&shalnotbeliablefornon-completionoftheevent,orforanydelaysarisingasaresultsofstrikes,riotsorlockoutsafectingtheowner oftheeventvenueoranythirdpartysupplierstoAthenaand/ortheevent,adverseweatherconditions,los,damageorcancelationduetofire,flood,oranyothercause beyondAthena’sreasonablecontrol. f.Althoughcarparkingareasarepatroled24hrsadayAthenadoesnotacceptresponsibilityforlosordamagetoyourvehiclewhilstonitspremises. g.DatesandtimingsadvertisedaresubjecttolicensingapprovalandasufficientlevelofticketsalesinthesoleopinionofAthena. h.PicturesusedinthisbrochurearefrompasteventsmanagedbyAthena-exactthemesets,costumesandentertainmentvaryfromvenuetovenueandfromyeartoyear. i.ItmustbeappreciatedthatAthenaisrequiredtobookandpayforlabour,entertainmentandcertainfooditemsinadvance. j.NothinginthesetermslimitsorexcludesAthena’sliabilityfordeathorpersonalinjurycausedbyitsnegligence,fraudorfraudulentmisrepresentation,oranyotherliability whichcannotbelimitedorexcludedbyapplicablelaw. k.Subjecttosub-paragraph(j)above,Athenashalhavenoliabilitytoyou,whetherincontractortortorotherwise,foranylosofprofitorofgoodwil,oranylosordamage whichisindirectorconsequentialorwhichdoesnotariseasadirectresultandnaturalresultofabreachofitscontractwithyouorwhichisnotareasonablyforeseeableconsequenceofsuchabreachandVivid’saggregateliabilitytoyou,whetherincontract,tort(includingnegligence),forbreachofstatutoryduty,orotherwise,arisingunderorinconnectionwiththeprovisionofitscontractwithyoushalbelimitedtotheamountofthepricepaidbyyoutoAthenaunderyourcontractwithVividfortherelevantevent. l.ThesetermsandconditionsaregovernedbyEnglishlawandintheunlikelyeventofadispute,thepartiesshalsubmittotheexclusivejurisdictionoftheEnglishcourts.
